KPC Facilities Management

1. Introduction

These Terms & Conditions (“Terms”) govern the use of services provided by KPC Facilities Management (“Company,” “we,” “our,” or “us”). By engaging our services, accessing our website, or entering into any agreement with us, you (“Client,” “you,” or “user”) acknowledge that you have read, understood, and agreed to be bound by these Terms.

KPC Facilities Management operates in the fields of interior design, real estate assistance, villa and home services, land-related support, and manpower supply. Certain services may be provided directly by KPC Facilities Management or through affiliated partner companies.

These Terms form a legally binding agreement between KPC Facilities Management and the Client.


2. Scope of Services

KPC Facilities Management offers comprehensive facilities-related solutions, including but not limited to:

  • Interior design, fit-out, and renovation services
  • Real estate consultancy and coordination
  • Villa and residential property services
  • Land-related assistance and support services
  • Home maintenance and facility solutions
  • Skilled and unskilled manpower supply
  • Coordination with third-party contractors and service providers

The exact scope of work, timelines, pricing, and deliverables shall be defined in a separate quotation, proposal, or service agreement provided to the Client prior to commencement.


3. Service Engagement & Acceptance

All service requests are subject to review and acceptance by KPC Facilities Management. Engagement begins only after:

  • Written confirmation or approval of the proposal
  • Agreement on pricing and scope
  • Receipt of advance payment (if applicable)

We reserve the right to refuse or discontinue services at our discretion if project requirements are not feasible, lawful, or aligned with our operational standards.


4. Partner & Third-Party Services

KPC Facilities Management may collaborate with third-party companies, subcontractors, or partners to deliver certain services. While we coordinate and facilitate such services, we are not responsible for:

  • Delays caused by third parties
  • Actions or omissions of third-party service providers
  • Quality issues beyond agreed contractual responsibility

Clients acknowledge that third-party services are subject to their own terms, warranties, and limitations.


5. Client Responsibilities

The Client agrees to:

  • Provide accurate and complete information
  • Grant timely access to properties or work locations
  • Approve designs, plans, and materials promptly
  • Ensure compliance with local laws and permissions
  • Provide safe working conditions where applicable

Any delays or additional costs resulting from client-side issues will not be the responsibility of KPC Facilities Management.


6. Pricing & Payment Terms

All prices are quoted based on the agreed scope of work and are subject to change if the scope is modified. Payment terms include:

  • Advance payments as specified in agreements
  • Final payment upon project completion or milestone delivery
  • Payments must be made within the invoice due date

Late payments may result in service suspension, additional charges, or contract termination.


7. Modifications & Variations

Any changes requested by the Client after approval of the original scope may result in:

  • Revised timelines
  • Additional costs
  • Updated agreements

All modifications must be documented and approved in writing before execution.


8. Project Timelines & Delays

Project timelines provided are estimated and subject to factors including:

  • Material availability
  • Government approvals
  • Client delays
  • Weather conditions
  • Third-party dependencies

KPC Facilities Management shall not be held liable for delays beyond reasonable control.


9. Manpower Services

Manpower supplied by KPC Facilities Management or partners is provided based on client requirements. The Client agrees that:

  • Manpower is not considered permanent employment
  • Supervision at site is the client’s responsibility unless agreed otherwise
  • Replacement may be provided subject to availability

We are not liable for misuse, negligence, or misconduct caused by manpower under client supervision.


10. Quality & Standards

We strive to deliver services that meet industry standards. However:

  • Materials and finishes may vary based on availability
  • Sample approvals do not guarantee identical final output
  • Minor variations are not considered defects

Any concerns must be reported in writing within a reasonable timeframe.


11. Intellectual Property

All designs, drawings, content, documents, branding, and materials created by KPC Facilities Management remain our intellectual property unless explicitly transferred through written agreement.

Clients are not permitted to reproduce, distribute, or modify our content without prior written consent.


12. Confidentiality

Both parties agree to maintain confidentiality of all proprietary, financial, and sensitive information shared during the course of service engagement. This obligation survives termination of the agreement.


13. Limitation of Liability

To the fullest extent permitted by law, KPC Facilities Management shall not be liable for:

  • Indirect or consequential damages
  • Loss of profit or business
  • Delays caused by external factors
  • Acts of third-party providers

Our total liability shall not exceed the value of the services agreed upon under the contract.


14. Insurance & Risk

Unless specifically agreed otherwise, KPC Facilities Management does not provide insurance coverage for client property, materials, or personal belongings. Clients are encouraged to arrange necessary insurance coverage independently.


15. Force Majeure

We shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Labor strikes
  • Pandemic-related disruptions

16. Termination of Services

Either party may terminate the agreement:

  • With written notice
  • In the event of breach of terms
  • For non-payment or misconduct

Termination does not relieve the Client of payment obligations for services already rendered.


17. Refunds & Cancellations

Refunds, if applicable, are subject to:

  • Work completed
  • Costs already incurred
  • Contractual terms

Customized or completed services are non-refundable unless otherwise agreed in writing.


18. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with applicable local laws. Any disputes shall be subject to the jurisdiction of competent courts.


19. Amendments

KPC Facilities Management reserves the right to update or modify these Terms at any time. Revised Terms become effective upon publication or notification.


20. Acceptance of Terms

By using our services, the Client confirms acceptance of these Terms & Conditions in full. Continued engagement constitutes ongoing acceptance.
